According to the criminal complaint, Gryskiewicz sexually abused the boy on three separate occasions between 2003 and 2006, when the victim was 7 to 9 years old. All incidents occurred during family get-togethers at the home of the child's grandparents, located in Eden Prairie.

The first instance of abuse occurred in January 2003, when Gryskiewicz was 17. He asked the boy if he wanted to play a game, took him to a room in the basement and locked the door. Inside the room, Gryskiewicz sexually assaulted the boy and did so again on a subsequent occasion. On the third and final occasion, the victim told the defendant, then 21, that he was scared and didn't want to do it anymore. The boy said he didn't report the alleged crimes because he was confused and didn't want to get his relative in trouble.
